Investment Requirements

Standard Investment:

$1.05 million in a new U.S. commercial enterprise.

Targeted Employment Area (TEA):

For investments in rural or high-unemployment areas, the required amount is reduced to $800,000.

Job Creation Obligation

The investment must create or preserve 10 full-time jobs for U.S. workers within two years of the investor’s conditional residency.

EB-5 Eligibility Requirements

Significant Investment

You must invest a minimum of $1.05 million in a U.S. business or $800,000 if investing in a Targeted Employment Area (TEA).

Job Creation

Your investment must generate or preserve at least 10 full-time jobs for U.S. workers within two years.

Endorsement by USCIS Regional Center

If investing through a USCIS-designated regional center, your application must align with the center’s economic growth objectives.

Active Involvement or Passive Investment

Choose between direct business management or a more passive investment through regional centers, depending on your business goals.

Good Financial Standing

You must demonstrate that your investment capital is lawfully obtained and provide evidence of financial stability throughout the process.

Investment Options
Direct Investment

Invest directly into a new business where you actively manage or participate in business operations and policy formation.

Regional Center Investment

Invest through USCIS-approved Regional Centers that focus on economic growth in designated areas. This option allows for passive investment and offers more flexibility in meeting job creation criteria.

EB-5 Visa Process

File Form I-526 – Immigrant Petition by Investor

Submit Form I-526 to USCIS, including documentation of the investment and job creation plan.

Obtain Conditional Permanent Residency

Upon approval of the I-526 petition, the investor and immediate family can apply for conditional permanent residency, enabling them to live and work in the U.S. for two years.

Remove Conditions on Residency – File Form I-829

Before the two-year anniversary of obtaining conditional residency, file Form I-829 to confirm the investment has been maintained and jobs have been created. This step leads to permanent resident status.
